Declarations

By using the DatingBBW website; resources, tools, utilities, content, information and any and/or all features and functionality of the DatingBBW web site in conjunction with any and/or all DatingBBW partners, third party vendors and/or strategic alliance partners (herewith known as DatingBBW) either as a Visitor, Registered User and/or as a Subscribing Member (herewith known as "YOU"), YOU affirm that YOU have read, understand and agree to and are bound by any and/or all Terms & Conditions of Service with are stated as policy and are defined within the scope of this agreement.

"Terms & Conditions of Service" mean the list of any and/or all conditions, clauses & sub-clauses contained within this agreement. These terms and conditions are the sole binding agreement between DatingBBW and YOU: the Registered User or Subscribing Member to the Service(s) of DatingBBW and/or any or all DatingBBW's agents, representatives, third party vendors and strategic alliance partners.
"Liability" means Liability for any and/or all damages, proceedings, actions, claims, costs and any other losses and/or liabilities.

"Service" means the service delivered by DatingBBW to YOU including, but not limited to; the access to specific information about, regarding or representing other Visitors, Registered Users, and/or Subscribing Members. In addition to access to other Users and Members by means of; messages, any or all related programs, any and/or all Instant Messenger features and/or functionality including any and/or all individual Chat function(s).

"YOU or derived versions of YOU", means registered user and/or the person whose application for membership of the Service is or has been accepted by DatingBBW.

"Subscribing Member" or "Member" means any person who has agreed to subscribe to the DatingBBW service and has paid the specified current subscription fee which affirms the membership for a chosen timeframe directly associated, assigned and related to the US dollar amount agreed upon and transferred by the specified billing/payment process between YOU and DatingBBW.

"Registered User" or "User" means any person who has complied with DatingBBW's request to fill out a "profile" which constitutes answers to some or all related answers provided to the range of questions made available on the various registration form screens, which answers will be reflected on the related end user profile, with the exception of answers to questions on the user's e-mail address and user's entry password. Any and/or all persons will be allowed free access to certain pre-defined parts of the DatingBBW Service. End user access will be continuous. However it is affirmed and agreed by YOU that "the access" is and will always remain the sole discretion of DatingBBW.

"Intellectual Property Rights" relates to any and/or all; database rights, copyright, design rights (registered, assigned or unregistered), trade marks (registered, assigned or unregistered), content rights with general content to include but not limited to: individual profile forms, Agony Aunt, registered, assigned or unregistered; and any or all other similar rights wherever directly related, applicable and associated to and with the existing scope of services provided with DatingBBW as they relate to any and/or all services "of type" represented on a regional, national and/or global fashion with the right to apply for protection of the same.

These Terms & Conditions of Service comprise all the stipulations related to the legally binding terms that are the foundation and/or basis for and of YOUR membership and/or use of the DatingBBW scope of services by YOU. These terms & conditions have been agreed to, affirmed and submitted as a binding legal agreement and are available upon request from our Customer Care department. The direct representatives of the DatingBBW have the expressed right and consent to modify, update, change and re-create this agreement at their sole discretion without specified notice and/or written consent; of, to and for YOU. As such, DatingBBW will commit and affirm to keep current this agreement which can be viewed and accessed by YOU at the designated URL.

Eligibility

This service is only available for persons over the legal age of 18 years of age. When YOU affirm to and/or accept the DatingBBW Terms & Conditions of Service, DatingBBW will assume that YOU are 18 years of age or older, due to YOUR affirmation, acceptance and acknowledgement and DatingBBW is expressly indemnified against any and/or all liability stemming from any and/or all potential legal action(s) as such relating to those person(s) who represent themselves of legal age who are constituted as "a minor individual" under the legal age of 18.
The DatingBBW service is not available for a person or persons who have been convicted of any and/or all offences relating to and/or falling under any State and or Federal laws related to Sexual Offenses and any or all statutory amendment(s) affiliated with, in replacement of and/or in addition to amending such Laws). Furthermore YOU affirm, accept and agree that the DatingBBW Service; representatives and agents are released from any and/or all related liability stemming and/or arising from possible or potential misrepresentation by YOU.

Indemnity

Any actions undertaken by YOU which constitute misuse, mis-representation and any or all other related actions which are deemed as such during YOUR use of the DatingBBW Service that does and/or will violate(s) and of the terms and conditions expressed within this legally binding agreement and/or comes to and does cause breach of Service YOU affirm and agree that YOU are wholly responsible. YOU therefore agree to indemnify, hold harmless and maintain such indemnification of all; shareholders, directors, management, subsidiaries, affiliates, employees, staff, partners and any or all individual(s) and/or person(s) are directly or indirectly part of the DatingBBW Service organization in any named and/or mentioned legal action(s) against all; losses, damages, demands, awarded costs, claims, demands, expenses, administration & legal costs and any or all parties harmless from any; loss, liability, claim, demand/or legal fees, made by any third party due to or arising out of YOUR use of the DatingBBW Service in violation of said Terms & Conditions of Service as it relates to this document.

DatingBBW are not responsible and holds no liability for any incorrect or inaccurate information, data or other content posted on the DatingBBW web site. This can mean any information and/or content entered by YOU, and/or by users of the Web site, Members or by any of the equipment or programming associated with or utilized in the Service. DatingBBW is not liable or responsible for conduct by; online or offline, of any user of the Web site or Member of the Service. DatingBBW assumes no liability and/or responsibility for any errors and omissions, interruption of service, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Registered User and/or Member communications. DatingBBW is not liable or responsible for any issues of occurrence and problems relating to technical malfunctions; telephone network, telephone lines, computer online systems, servers, providers, computer equipment, software, failure of email or other communication software due to technical problems, traffic congestion on the Internet or any non-related web site thereof. . You further affirm this to include injury or damage to Registered Users and/or Members and/or additional computer systems which YOU may be using which are not YOUR own as it relates to any issue or action resulting in participating or downloading materials in connection with the World Wide Web and/or in connection with the Service. YOU agree and affirm to release DatingBBW from all liability in connection with and relating to any loss or damage including; personal injury or death, resulting from anyone's use of the Dating BBW Service, any and/or all content posted on the Web site or transmitted to YOU, or any interactions between YOU and other users of the Web site and the DatingBBW service, whether online or offline. The Web site and the Service are provided "AS-IS" and DatingBBW expressly disclaims any warranty of fitness for a particular purpose or non-infringement. DatingBBW cannot guarantee and does not promise any specific results from use of the Web site and/or the Service.

Advice

DatingBBW will supply the feature of Agony Aunt to supply solicited and unsolicited questions by YOU relating to past, present and future relationships as they relate to YOU and either a named and/or un-named third party. YOU agree and affirm that YOU understand any questions from users will be answered. YOU further acknowledge and affirm that any answers provided by a member(s) of the DatingBBW staff or agents, representatives and/or additional parties who have access to Agony Aunt to provide related responses to users questions should not be interpreted as; formal and/or informal therapy, medical services (licensed or unlicensed) and/or interpreted by YOU on the basis of personal and/or professional counseling in any form or context specific advice to solve problem(s) or to take action based on or by the response(s) YOU receive from Agony Aunt relating to the question(s) posed by YOU in the use of this feature. Users suffering from personal problems or seeking specific advice to their personal situation are urged to find and consult with "a professional" (medical or otherwise) as it relates to the nature of their question(s) relating to the specialization of the issue(s). YOU affirm and agree to indemnify and release DatingBBW, its staff, agents, third parties and any or all other representatives who support the Agony Aunt feature from any and/or all liability in relation this service in the form of answered question(s), or observations communicated by users.

Rules

As a Registered User and/or Subscribing Member to the DatingBBW service YOU agree and affirm that DatingBBW has the right to suspend and/or delete YOUR profile, membership and any or all items relating to YOUR registration with the DatingBBW service without written or verbal affirmation to YOU for non-compliance of the terms and conditions listed below which formally constitutes misuse and violation of the DatingBBW service agreement therefore are strictly prohibited from:

• DatingBBW do not allow registered users to have profiles in more than one of their dating websites, unless a monthly membership has been taken out on at least one dating website. Violations of this rule will result in being refused registration in the second or subsequent DatingBBW website.
• Only one profile per dating website is permitted.
• Passing on or uploading any or all personal information relating to and/or including; home/business telephone numbers, other telephone numbers, details of third parties, last names, addresses, zip codes, cellular phone numbers, e-mail addresses, ICQ numbers, references to groups or communities as part of Yahoo, Excite, MSN and/or other similar portals, other dating or community websites, profiles, references to e-mail addresses and/or other means and/or ways or information where and how you can be contacted directly and outside DatingBBW as they relate to Registered Users or members of the DatingBBW service, unless this is done in the Chatroom or in the DBBW instant Messenger.
• Using YOUR profile to list contact details of YOU relating to and/or including home/business telephone numbers, other telephone numbers, details of third parties, last names, addresses, zip codes, cellular phone numbers, e-mail addresses, ICQ numbers, references to groups or communities as part of Yahoo, Excite, MSN and/or other similar portals, other dating or community websites, profiles, references to e-mail addresses and/or other means and/or ways or information where and how you can be contacted directly and outside DatingBBW.
• Using the service to promote specific in any other form of enterprise; personal venture, licensed and/or non-licensed business venture, commercial venue, and/or other service irrespective of its nature relating to non, not for and for profit in an attempt to directly or indirectly represent services and products to any or all users, members and visitors who use the services of DatingBBW.
• Passing on or uploading any; photographs (personal, those belonging to a third party and any or all additional "photographed elements" either copyrighted and/or non-copyrighted), pictures, animation(s) and/or other data and/or information that can be deemed to be an infringement or infringements of privacy, intellectual Property and copyright laws as defined and applied to such law(s) in the United States.
• Passing on or uploading any photographs, pictures, animations and/or other data and/or information of a sexually explicit nature and/or contravenes common decency standards and/or violate any State and/or Federal laws related to sexually explicit and/or obscene images and legislation on decency and related legislation.
• Passing on information that is of the nature relating to; sexually suggestive, obscene, defamatory, threatening, racist, demeaning, sexually discriminative content, links and information that can be construed as to be libelous to the DatingBBW service, their agents, representatives, third party subscribers, site visitors and/or members.
• Allowing third parties to gain access to the service by passing on YOUR login and password details and any or all additional related to the DatingBBW service which is considered of a "proprietary nature" to others; third parties, agents, representatives, competitors and/or additional individuals or organizations who may gain or benefit either in a non, not for and/or for profit environment.
• Attempting to gain information and/or data for other purposes other than the defined primary and single (individual) use of the DatingBBW service as they relate to the intention, understanding and definition of "the use" of the DatingBBW service.
• Passing on to third parties; Internet based vehicles (not limited to but including web sites, personal home pages, third part home pages, profiles pages provided by Internet Service providers and web hosting providers) and/or related and non-related hard copy, print and offline media information in whatever format, style and content and detail about; the Dating service, registered agents, third parties and/or representatives of Dating BBW and/or members, registered users and visitors who participate in the Dating service.
• Directly involving DatingBBW in any disputes, disagreements or negative form of action YOU may have with other members, registered users, third party agents and/or named representatives of the DatingBBW service. YOU agree and affirm that YOU are wholly responsible for any such disputes and YOU shall inform DatingBBW of the existence of such dispute within a 24-hour period of such occurrence and/or incident. It is at the sole discretion of DatingBBW's management, named agents and/or third part representatives to either take proactive action in order to mediate said and individual dispute(s). If a "dispute" is found to interrupt or cause action to disturb other members and registered users of the DatingBBW service and found to interfere in any way with compliance and terms and conditions relating to the service between DatingBBW and other members and registered users, disputing members and/or registered users shall be immediately suspended from access and/or means of accessing the DatingBBW service until such time the dispute(s) and/or incident is resolved, with or without mediation by DatingBBW.

Termination of Membership

Both DatingBBW and YOU may terminate this Agreement at any time, for any reason. Termination of the agreement by either party will be effective upon receipt of written notice with stated specification of termination to the other party. Termination by a member of their individual membership can be undertaken via e-mail. All email notifications for individual membership termination can be sent to adminn@datingbbw.com. In taking action to terminate individual membership the request for termination must state: the individual member's username and e-mail address of the person who owns the e-mail address and who whishes to terminate his/her membership from date requested stated termination date. Additionally individual membership can be terminated by using the DatingBBW menu option Cancel My Account and then sending written notification to DatingBBW with the individual member indicating their termination request. The individual membership will be terminated by the DatingBBW service upon the next forthcoming date when individual membership payment fee is billable. Individual membership is automatically billable and affirmed as "renewed and/or recurring" until such time individual member(s) notify DatingBBW staff, registered agents, and/or any or all assigned named representatives of the DatingBBW service of intent to terminate individual membership or halt further recurring payments.

In case of breach of any and/or all statements within or relating to the DatingBBW the Terms & Conditions, DatingBBW may and will terminate an individual membership of the member(s) responsible for any such breach "at their discretion." This/these individual member(s) will be notified by DatingBBW via e-mail form of said termination and termination(s) will be effective upon DatingBBW sending such e-mail to the member(s). If and/or when DatingBBW terminates individual membership(s), terminated member(s) agree and affirm they are not entitled to any refund(s) paid by them for any and/or all future services paid for in advance to use the services of DatingBBW. It is further agreed and affirmed by YOU that YOU are bound to the Terms & Conditions related to disclosing information of other members and registered users as well as all copyright clauses.

Copyright(s)

The DatingBBW web site contains proprietary content, designs, graphic(s), images and other materials, trademarks and features that are owned by DatingBBW, named registered agents, third party providers and named representatives and are all deemed and are subject to copyright law and infringements is applied by YOU and/or in any other fashion outside of DatingBBW and named agents of DatingBBW. Only data that is deemed to be in the public domain or for which YOU have received written permission signed by one of the directors of the DatingBBW organization and/or public domain information, relating to YOUR individual membership. YOR DatingBBW profile is not applicable in the context of copyright infringement. YOU agree and affirm YOU are prohibited from copying, modifying, publishing, distributing, transferring, broadcasting, displaying, or selling any such proprietary information If violated in any fashion YOU agree you are held responsible and are potentially legally responsible for any and/or all related damages incurred relating to taken action if copyright infringements occur.

Personal Information

DatingBBW has the right to; review, alter, modify and/or reject any content, personal information, photographs and/or other information entered by YOU as it relates to each and/or all profile form field, written description and/or additional information upon completion of YOUR completed profile. If found the information YOU have entered is deemed unsuitable or to be of an offensive nature, questionable legality, and/or in the discretionary case DatingBBW feels it may threaten the safety of DatingBBW members, registered users and site visitors. YOU are solely responsible for all the content that YOU upload to our website or to our members and/or registered users.

Price of service

The price of individual membership subscription to the DatingBBW service is stated upon joining and/or the membership page. DatingBBW has the right to change and/or alter the price of services without notice. . Notice relating to any forms of price increases, discounts, special promotion pricing or adjustments will be provided on DatingBBW's information pages. Payments made by individual members in order to obtain membership(s) for the use of the DatingBBW website are strictly non-refundable and/or non-transferable. YOU agree and affirm that by agreeing to these Terms & Conditions, YOU will automatically forfeit any rights of charge back(s) to YOUR Credit Card Company, Credit Card Provider and/or Credit processor for any and/or all reason(s) for the services made available by DatingBBW. If YOU undertake any charge back action from YOUR Credit Card Company, Credit Card Provider and/or Credit Card Processor, YOU agree and affirm DatingBBW has the right to pursue any and/or all avenues including naming YOU in "judgment" with any local, regional, State and/or Federal court(s) in order to obtain repayment of the charge back amount plus costs. YOU further agree and affirm that if any such judgment and/or action is taken YOU shall incur the costs on behalf of DatingBBW including but not limited to: attorney fees, court fees, mediation fees, travel expenses, and/or additional costs incurred on the part of DatingBBW its directors, representatives, lawyers and/or agents.

Payment of service

YOU agree and affirm all individual membership(s) payment(s) shall be made by YOU indicated in the appropriate joining and/or membership pages. Payments are made when DatingBBW has received; appropriate credit card authorizations, cash, transferred funds and/or postal/money orders applicable and totaling the required membership amount due have been cleared and/or processed as confirmation. Membership subscription payments are non-refundable.

Information obtained by DatingBBW

In order to deliver the best possible service, i.e. finding the most suitable partners for our members, DatingBBW will collect information from its members. This information includes username, age, sex, various preferences, professional information etc. This is referred to as Public Information and is used to allow other individual members and/or users as well as DatingBBW's management, directors and agents to access such information. Some of this public information and applicable profile field codes are available to registered users and DatingBBW web site visitors. As it relates to searches by members, registered users and site visitors, YOUR information is and/or may be accessed and matched to specified requirements made by other users, members and/or visitors. In addition, we collect information; personal name(s), mailing address, birth date, credit card information, IP address and any and/or all additional information which is deemed as "personal". This information is Private Information and shall not be divulged to any third party with the exception of the DatingBBW credit card company/processor in order to validate if YOUR information is correct and to protect YOU from any fraudulent use of YOUR credit card.

DatingBBW; its staff, owners, shareholders, named agents, registered third party providers and representatives (herein known as DatingBBW and/or any or all related agents of DatingBBW) are not in any way responsible for the inaccuracy of any content produced and/or displayed as part of members' and/or registered users' profiles which forms part of the service. Such inaccuracies, alterations, deliberately or accidentally deceptive information and other omissions, submitted by design, or by accident are the full responsibility of the member and/or registered user of the service.
Therefore, YOU agree and affirm DatingBBW (and any related parties) cannot be held responsible for any action, incident and/or occurrence stemming from said inaccuracy. DatingBBW and/or any or all related agents of DatingBBW do not provide any warranty and/or guarantee of results relating to the DatingBBW service including but not limited to: expected or perceived results, availability, and/or uninterrupted use of the Service.

DatingBBW and/or any and/or all related agents of DatingBBW are not in any way responsible and as such cannot be held responsible for failures of and damage to of browser software applications, e-mail applications, web sites, computer hardware, networks, drives and/or peripherals.

DatingBBW and/or any or all related agents of DatingBBW are not in any way responsible and as such cannot be held responsible for losses, failure or other damage, including personal damage, injury or death, resulting from the use of the DatingBBW Web site and/or the Service and/or its content or any interactions between users of the service in whatever form.

DatingBBW and/or any or all related agents of DatingBBW cannot be held responsible in any way or by any means for the absence of any search results or any other results expected through using the service and/or the website.

DatingBBW and/or any or all related agents of DatingBBW cannot be held responsible in any way or by any means for communication failure, delays, unauthorized access.

DatingBBW and/or any or all related agents of DatingBBW cannot be held responsible in any way or by any means for malfunction of YOUR computer hardware, modem, drives, networks, telephone line, software, operating system and/or peripherals.

DatingBBW and/or any or all related agents of DatingBBW cannot be held responsible in any way or by any means for damage, loss, injury, and/or death as a result of the use of our website.

Disputes

YOU agree and affirm if there is any dispute about and/or involving the DatingBBW Web site, the Service and/or DatingBBW staff or related agents of DatingBBW, by YOUR use of the Web site and/or service, YOU agree that the dispute will be governed by the laws of the United States court and jurisdictional system for any and/or all related actions as applicable to; criminal, civil, appellate, federal courts and/or relevant governing statutes at the local, regional and/or national, State and/or Federal level as appropriate, based on said action This Agreement is governed by and interpreted in accordance with and and/or all related statues and laws of the United States as specified above.

Other

YOU agree and affirm this Agreement as affirmed and accepted by YOU upon checking the form field box expressly indicating that the Terms & Conditions of Service have been read, understood and agreed to and includes the agreement in its form and entirety on all Terms & Conditions between YOU and DatingBBW as they relate to the use of the DatingBBW Web site and/or the Service. If any provision of this Agreement is proved invalid, the remainder of this Agreement shall continue in full force and effect.
